సృజన్‌ అనే ఒక సాఫ్ట్‌వేర్‌ ఇంజనీర్‌.. ఐఫోన్‌ మొబైల్‌ను ₹1 లక్ష వెచ్చించి ఒక ఎలక్ట్రానిక్ షోరూమ్‌లో కొనుగోలు చేశాడనుకుందాం.📱 దీని కోసం అతడు ఈఎంఐ సదుపాయాన్ని వాడుకున్నాడు. 💳 దీని ప్రకారం ప్రతి నెల 5వ తేదీ నెలవారీ వాయిదా చెల్లించాలి. 🗓️ ఈ విధంగా నెలకు ₹9,000 చొప్పున 12 నెలలు అంటే ఏడాది పాటు చెల్లించాలి. 🤯 అంటే ₹1 లక్షకు గాను ₹1,08,000 చెల్లించాల్సి ఉంటుంది. 💸 ఒకవేళ నిర్ణీత గడువు లోపులో నెలవారీ వాయిదా కట్టలేకపోతే పెనాల్టీ కింద నెలకు ₹500 చెల్లించాల్సి ఉంటుంది. 🏦
అయితే ఇక్కడ తెలుసుకోవాల్సిన విషయం ఏమిటంటే.. ఇలా పెనాల్టీ కింద వసూలు చేసిన మొత్తంపైన జీఎస్‌టీ చెల్లించాల్సి ఉంటుందా అని. 🧐
పెనాల్టీ మీద జీఎస్‌టీ:
పెనాల్టీ కింద వసూలు చేసిన మొత్తం పైన జీఎస్‌టీ వర్తిస్తుందా లేదా అనేది రుణ సదుపాయం ఎవరు కల్పించారనే విషయంపై ఆధారపడి ఉంటుంది. 📑 అంటే దుకాణాదారుడే ఆయా వస్తువులను కొనుగోలు చేయటానికి స్వయంగా రుణం ఇచ్చి నెలనెలా తనే వాయిదాలను స్వీకరిస్తుంటే.. అలాంటి సందర్భాల్లో వసూలు చేసే పెనాల్టీ లేదా అదనపు వడ్డీల మీద కచ్చితంగా జీఎస్‌టీ చెల్లించాల్సి ఉంటుంది. 🏷️
అలాకాకుండా పైన చెప్పిన విధంగా మాల్స్‌ లేదా పెద్ద షోరూమ్‌ల యజమానులు తమ కొనుగోలుదారులకు రుణ సదుపాయం కల్పించటానికి బయటి ఫైనాన్స్ సంస్థలతో ఒప్పందం కలిగి ఉంటాయి. 💼 దీని ప్రకారం కొనుగోలుదారుడికి ఆయా ఫైనాన్స్ సంస్థలు వస్తువులను కొనటానికి ఫైనాన్స్ చేస్తుంటాయి. 💵
ఉదాహరణ - 2:

Many items that were once considered luxury goods have now become necessities. 🏠 With changing times, people's lifestyles and preferences have evolved. 💡 The purchasing power has increased. 💪 Most importantly, EMI options, which were once only available to government employees, are now accessible to business people and private sector employees as well. 👨💼👩💼
On the other hand, technology is advancing rapidly. 📱💻 Young people are increasingly interested in changing mobile phones and laptops every 2-3 years to keep up with the latest technology. 🧑💻 Keeping this in mind, electronic showrooms and shopping malls have set up special facilities to offer products on easy EMI options. 🏬 Some stores directly provide finance, while others have arrangements with external financial institutions for offering finance. 💸
Depending on the product and the buyer's income, various loan options are available for purchasing items. 🏷️ The EMI (Equated Monthly Installment) amount is determined, and the buyer has to pay it by the due date every month. 🗓️ If there is any delay in payment, a penalty amount is collected. 🏦 In some cases, an additional interest fee may also be charged. 💳
Now, the question arises: Do you need to pay GST on the extra amounts collected due to delays? 🤔 Let’s explore the procedures through an example.
Example:
Let’s assume Srujan, a software engineer, purchases an iPhone for ₹1 lakh at an electronic showroom 📱 and opts for EMI. 💳 According to the terms, he has to pay ₹9,000 every month for 12 months. 🤯 So, for ₹1 lakh, he ends up paying ₹1,08,000 over the course of the year. 💸 If he fails to pay on time, a penalty of ₹500 per month will be charged. 🏦
But the key question here is whether GST should be paid on the penalty amount collected.
GST on Penalty Amount:
Whether GST applies to the penalty amount depends on who is providing the loan. 📑 If the store itself is providing the loan and collecting the EMIs directly, then GST will definitely apply on the penalty or any additional interest collected. 🏷️
However, if the store or mall owners have an agreement with an external financial institution for offering finance to customers, then GST does not apply to the penalty amounts. 💼 In this case, the financial institution provides the loan to the customer for purchasing the product. 💵

Thus, if a sale happens and the seller collects not only the principal amount but also any interest or penalty fees from the buyer, GST will apply to the entire amount collected. 💸
