**వివాదానికి నేపథ్యం:**
గత ఏప్రిల్లో ప్రభుత్వం జారీ చేసిన నోటిఫికేషన్ ప్రకారం, అభ్యర్థులు అర్హత మేరకు SGT, SA, TGT, PET వంటి వివిధ పోస్టులకు దరఖాస్తు చేసుకున్నారు. పిటిషనర్లు SGT, SA పోస్టులకు పరీక్ష రాసి, రెండింటిలోనూ అర్హత సాధించి, మెరిట్ జాబితాలో ర్యాంకులు కూడా పొందారు. అయితే, దరఖాస్తులో SGTకి ప్రాధాన్యత ఇవ్వడం వల్ల, వారికి SA పోస్టుకు అవకాశం కల్పించలేదు. దీనిని సవాల్ చేస్తూ కర్నూలుకు చెందిన బండేగిరి బషీరున్ సహా 10 మంది అభ్యర్థులు హైకోర్టును ఆశ్రయించారు.

**Amaravati, September 16 (Andhra Jyothi):** A High Court bench has taken exception to the practice of asking candidates to select preferences at the application stage for DSC-2025 teacher recruitments. It suggested that candidates should be allowed to choose their preferred posts only after the merit list is published. The bench commented that it is incorrect to disqualify candidates from the School Assistant (SA) post, despite them having secured merit in both Secondary Grade Teacher (SGT) and SA exams, solely because they indicated SGT as their preference in the application. The court noted that separate applications, fees, and exams were conducted for both SGT and SA posts.
The bench has referred the matter of preference to a single judge and instructed that a final verdict be delivered within four weeks. The order was issued by a bench comprising Justices Battu Devanand and Hari Hara Nath Sharma, addressing an appeal filed by the Principal Secretary of the School Education Department against the single judge's orders.
**Background of the Dispute:**
As per the notification issued by the government last April, candidates applied for various posts like SGT, SA, TGT, and PET based on their eligibility. The petitioners appeared for and qualified in both the SGT and SA exams, also securing ranks in the merit list. However, they were not given the opportunity for the SA post because they had prioritized the SGT post in their application. Challenging this decision, 10 candidates, including Bandagiri Basheerun from Kurnool, approached the High Court.
**Single Judge's Verdict:**
After hearing the petitions, the High Court single judge, Justice N. Vijay, ruled that it is unjust to deny a candidate an opportunity for the SA post despite their merit, solely based on the preference indicated in the application. Emphasizing the importance of merit, the judge issued interim orders to consider the petitioners for the School Assistant posts.
**Advocate General's Arguments:**
During the hearing, Advocate General Dammalapati Srinivas argued that once a preference order is chosen, it cannot be changed, and candidates cannot challenge government regulations. He stated that since there were more SGT vacancies, many candidates opted for those posts. He warned that accepting the petitioners' plea might lead to more candidates approaching the court.
