జీఎస్టీలో కొత్తగా వచ్చిన మార్పులు

జీఎస్టీ చట్టంలో ఇటీవల కొన్ని కొత్త మార్పులు చోటు చేసుకున్నాయి. ఈ మార్పులు వ్యాపారవేత్తలూ, సాధారణ పౌరులూ తెలుసుకోవలసినవి. వాటిని ఇక్కడ వివరంగా చూస్తాం.
1. సెకండ్ హ్యాండ్ కార్ల పై మార్పులు
మొదటి మార్పు సెకండ్ హ్యాండ్ కార్లకు సంబంధించినది. సెకండ్ హ్యాండ్ కార్ల మార్కెట్ రోజురోజుకూ విస్తరిస్తోంది. పెద్ద కార్ల కంపెనీలు కూడా సెకండ్ హ్యాండ్ కార్ల కోసం ప్రత్యేకంగా షోరూమ్లు తెరుస్తున్నాయి. ఈ కార్లకు కొత్త కార్ల మాదిరిగానే ఫ్రీ సర్వీసింగ్ మరియు వారంటీ అందిస్తున్నారు.

స్పెసిఫైడ్ ప్రెమిసెస్ అర్థం గతంలో హోటల్ రూమ్ యొక్క డిక్లేర్డ్ టారిఫ్ ఆధారంగా ఉండేది. కానీ ఇప్పుడు, గడచిన ఆర్థిక సంవత్సరం లో వసూలు చేసిన వాస్తవ రూమ్ ధర ఆధారంగా జీఎస్టీ నిర్ణయిస్తారు.

రివర్స్ చార్జ్ మెకానిజమ్లో కొన్ని మార్పులు కూడా చోటు చేసుకున్నాయి. ఒక వాణిజ్య భవనం జీఎస్టీ రిజిస్ట్రేషన్ లేని వ్యక్తికి అద్దెకు ఇచ్చే సందర్భంలో, అద్దెకు తీసుకున్న వ్యక్తి లేదా సంస్థ జీఎస్టీ రిజిస్ట్రేషన్ కలిగి ఉంటే, ఆ అద్దెపై జీఎస్టీ చెల్లించాల్సిన బాధ్యత అద్దెదారునిదే ఉంటుంది.
గత అక్టోబరులో ఈ నిబంధన అమల్లోకి వచ్చింది. అయితే, ఇప్పుడు ఈ సవరణ చేసింది. కాంపోజిషన్ స్కీమ్ కింద నమోదు చేసుకున్న వ్యక్తికి రిజిస్ట్రేషన్ ఉన్నా, రివర్స్ చార్జ్ మెకానిజం వర్తించదు.
అలాగే, స్పాన్సర్షిప్ సర్వీస్ కూడా రివర్స్ చార్జ్ మెకానిజంలో భాగం అయింది. అయితే, సర్వీస్ ప్రొవైడర్ బాడీ కార్పొరేట్ కింద గుర్తింపు పొందితే, రివర్స్ చార్జ్ మెకానిజం వర్తించదు. ఈ మార్పులు కూడా జనవరి 16, 2025 నుండి అమల్లోకి వచ్చాయి.

What Are the Recent Changes in GST?

There have been some recent changes in the GST Act. Here are the detailed updates for your understanding:
1. Changes for Second-Hand Cars
The first change relates to second-hand cars. The market for second-hand cars is expanding rapidly. Even major car companies are opening separate showrooms for these vehicles. They are offering free servicing and warranties for second-hand cars, similar to new cars.
Now, sellers of second-hand cars need to pay GST on the margin (the difference between the buying price and the selling price) rather than on the full sale value. This means that GST will be applicable only on the profit margin. If the car has been registered under the Income Tax (IT) Act for depreciation, the remaining net value after depreciation is considered as the purchase price for calculating the margin.
GST rates on second-hand cars were previously between 12% and 18%, depending on factors like car capacity, length, and type. Now, the GST rate for all types of cars has been fixed at 18%. This change has been implemented since January 16, 2025.
2. Changes for Restaurants
There have also been changes related to restaurants. Now, the GST applicable on restaurant services in a hotel depends on whether the hotel falls under the specified premises category. If it is considered "specified premises," the GST rate will be 18%, and if not, it will be 5%.
Earlier, "specified premises" was determined based on the declared tariff of the hotel rooms. However, under the new definition, it will now be based on the actual room rent collected in the previous financial year.
Additionally, restaurants in specified premises can now pay 18% GST and claim Input Tax Credit (ITC). This change will come into effect on April 1, 2025.
3. Changes in Reverse Charge Mechanism
Some modifications have also been made to the Reverse Charge Mechanism (RCM). If a commercial property is rented out to a person or organization that has GST registration, the tenant (or lessee) will be responsible for paying the GST under the reverse charge mechanism. This rule was introduced in October 2024.
However, the new revision states that if the tenant is registered under the Composition Scheme, the reverse charge mechanism will not apply, even if they have GST registration.
Also, sponsorship services have been brought under the reverse charge mechanism. But if the service provider is recognized under a body corporate, the reverse charge mechanism will not apply. These changes have also been implemented from January 16, 2025.
